terms of use.

wareby is a marketplace for verified local businesses, run by tandoco, our holding company, based in minneapolis, minnesota. when these terms say “wareby”, “we” or “us”, they mean that company. “you” means anyone using shopwareby.com.

by using wareby you agree to these terms, our privacy policy and our returns and refunds policy. shops also agree to our seller agreement.

you can browse without an account. to order, earn warebucks or message a shop, you’ll make one. it’s free, and there’s no password: you sign in with a code we send you.

• you need to be at least 18, or have a parent or guardian’s permission to use wareby.
• one account per person, with your real name and contact details.
• keep your sign-in to yourself. you’re responsible for what happens in your account.
• you can change your details or delete your account anytime in settings.

every shop on wareby is an independent local business. the shop sets its prices, what’s available, its pickup times, delivery area and shipping, and its return policy. when you place an order, you’re buying from that shop, and wareby takes the payment on the shop’s behalf.

• you can fill one cart from many shops and check out once. each shop gets its own part of the order.
• sales tax is added at checkout where it applies.
• prices and descriptions come from the shops. if a shop makes a clear mistake, like a wrong price, it can cancel that part of your order and you’ll get a full refund.
• if you have an allergy or a special need, ask the shop before you order. you can message any shop from its page.

your card is charged when you check out. if a shop can’t fill your order, it cancels it and you get a full refund. you can ask a shop to cancel before it starts making your order. for mailed orders, you can cancel any part that’s past its ship-by date.

refunds go back to how you paid. the details are in our returns and refunds policy.

each shop handles getting your order to you. at checkout you choose pickup, local delivery or shipping, from what that shop offers.

• pickup: come during the window you picked. the pickup spot is in your order confirmation.
• delivery: give an address the shop can reach, and someone to receive it if it can’t be left.
• shipping: the shop ships by the date shown and sends you tracking.

warebucks are wareby’s rewards. you earn them on eligible orders and spend them at any shop on wareby. the shop is still paid in full.

• warebucks have no cash value. they can’t be cashed out, sold, or moved to another account.
• warebucks earned on an order that’s canceled or refunded are taken back. warebucks you spent on it come back to you.
• we can remove warebucks that were earned by mistake or through abuse.
• we may change how many you earn or what they’re worth. if we ever end the program, we’ll give you at least 30 days to spend them.

what you post on wareby, like reviews, photos and messages, stays yours. you give us permission to show it on wareby and to use it to run and promote wareby.

• reviews have to be honest and about a real order.
• don’t post anything you don’t have the right to share, or anything hateful, harassing or illegal.
• we can remove content that breaks these rules.

• fraud, scams, or using someone else’s payment details.
• fake accounts, fake reviews, or paying for reviews.
• harassing shops, shoppers or our team.
• copying wareby’s content or collecting data from the site with bots.
• anything that breaks the site or gets around our security.

we can suspend or close accounts that break these terms.

the wareby name, logo, design and the words we write belong to us. shops’ names, photos and listings belong to the shops.

we check every shop before it opens and we keep an eye on things, but the shops make and sell the items, so they’re responsible for them, including what’s in food. wareby is provided “as is”, and we can’t promise the site will always be available or error free.

to the extent the law allows, wareby isn’t responsible for indirect losses, and our total responsibility for a claim is limited to the greater of what you paid for the order in question or $100. nothing here limits rights you have under the law that can’t be limited.

please talk to us first at hello@shopwareby.com. most things get sorted quickly. these terms are governed by minnesota law, and any legal dispute goes to the state or federal courts in hennepin county, minnesota, though either of us can use small claims court instead.

we’ll update these terms as wareby grows. the date at the top shows the latest version. if a change is big, we’ll tell you by email or on the site before it takes effect.
